The case may not have been successful if it had gone ahead. Google uses Face Recognition in Images to help you search for famous people and pets, and it can only associate names with faces when you tag them. The Biometric Information Privacy Act requires consent to the collection of personal identifiers, but it is not clear that the information really identifies.
